Developing a Workplace-related Dispute Management and Resolution Mechanism Concept

PMCG has developed a concept for the introduction of a mechanism of workplace-related dispute management and resolution to promote healthy and stable labor relations in the Ministry of Economy and Sustainable Development of Georgia, as part of the USAID HICD Activity, implemented by PMCG as a subcontractor to Kaizen, a Tetra Tech company.

Crucially, we endeavor to engage in dispute resolution and prevention at an early stage, ensure the minimization of potential reputational risks, provide prudent ways of eliminating conflicts of interest, and offer opportunities to discuss issues in a less formal environment. The introduced mechanism is practical, effective, and reliable, and should become part of the corporate culture and be adapted to the specifics of the Ministry and its subordinated agencies, LEPLs, state-owned companies, etc.

Following baseline research on labor-related dispute statistics and outcomes at the Ministry, as well as a study of international practices, the project team proceeded with the active engagement of a working group of HR managers at the the Ministry to discuss and analyze various models of the mechanism. As a result, the concept of an impartial mediation mechanism was developed, with its composition, scope of mandate, authority, and specific tasks and functions all defined.

As a result, an independent and neutral mediation body will be established in the system of the Ministry, which will be a flexible and effective tool for alternative resolution of disputes and will reinforce the principles of impartiality and integrity.
